The Renters’ Rights Bill: A New Era for Private Rented Housing Standards?
The Renters’ Rights Bill marks a significant shift in the landscape of private rented housing in the UK. While the abolition of Section 21 and fixed-term tenancies have garnered much attention, the Bill also introduces substantial changes to the way housing standards are assessed and enforced.
Key changes include:
- A Decent Homes Standard will be introduced for the private rented sector, with fines of up to £7,000 for non-compliance. This standard, currently applied to social housing, will ensure properties are free from hazards and may include regulations regarding the age of fixtures and fittings.
- Awaab’s Law. In the wake of the tragic and entirely avoidable death of toddler Awaab Ishak due to mould in his housing association home, Awaab’s Law will be extended to private renting, setting clear timeframes for landlords to rectify serious hazards. This will empower tenants to take legal action against landlords who fail to meet their obligations.
- A digital private rented sector database will be created, providing information for landlords, tenants, and local authorities.
- Local authority enforcement powers will be strengthened, allowing for greater investigation and entry into PRS properties, along with increased financial penalties for non-compliance.
The Housing Health and Safety Rating System, currently used to assess hazards in residential premises, is under review. It will be interesting to see how this system interacts with the new Decent Homes Standard.
These changes aim to create a safer and fairer private rented sector, offering tenants greater protection and holding landlords accountable for maintaining decent living conditions.
